The Stilfontein Regional Court has sentenced Carel Fouche, 33, to life imprisonment for murdering his two year old step grandson. The Carel Fouche life sentence brings an end to a case that began with a brutal attack on the toddler in May 2025.
Fouche pleaded guilty to the murder. In addition, the court declared him unfit to own a firearm.
What led to the Carel Fouche life sentence
On the night of 15 May 2025, Fouche used crystal methamphetamine with the child’s grandmother, who was his partner at the time. According to the State, he had a long history of drug dependency.
Later that night, the little boy woke up and started crying. This angered Fouche, who then woke the child and attacked him.
The next morning, Fouche went to neighbours to ask for help. However, he allegedly acted as if he had no idea what had happened to the boy. Paramedics arrived and declared the child dead at the scene. Police then arrested Fouche, and he has stayed in custody since.
During the trial, the State showed that the child had suffered about 20 injuries. A doctor who examined the boy’s body told the court that the injuries came from repeated blows with an object. Furthermore, some injuries matched slaps and punches from an adult.
In mitigation, the defence told the court that Fouche had a difficult upbringing. According to his lawyers, his parents abandoned him and his grandparents raised him. He also left school in Grade 8 and later joined gang members because of peer pressure. In addition, the defence pointed out that he pleaded guilty and cooperated with the State.
However, the State rejected these arguments. Prosecutors told the court that Fouche had previous convictions going back to 2011, including violent crimes. He had earlier served a four year sentence for housebreaking and was still on parole until 2027. According to the State, his past punishment did nothing to stop him.
The State also stressed how serious the crime was. It argued that Fouche killed a defenceless child who depended on him for care and protection. Moreover, prosecutors said his use of an object during the attack showed its cruelty.
For now, the Carel Fouche life sentence ensures that he will remain behind bars, as the case adds to growing concern about violence against children in South Africa.
