The Hartswater Regional Court in the Northern Cape has handed down a Hartswater father life sentence to a 41 year old man who raped his 14 year old daughter. DNA testing confirmed that he fathered the child she later gave birth to.

The court convicted the man on one count of rape and one count of sexual assault. It sentenced him to life imprisonment for rape and five years for sexual assault, with both sentences running concurrently.

To protect the girl’s privacy and dignity, authorities have not released the man’s name.

How the Hartswater father life sentence case unfolded

According to the National Prosecuting Authority, the crime took place in October 2021. At the time, the man invited his children to his home to celebrate his birthday.

Early the next morning, the girl and her younger siblings were sleeping in the same bed as their father. After the younger children left the room, he stopped the girl from getting up and assaulted her.

NPA Northern Cape spokesperson Mojalefa Senokoatsane said the father then threatened the teenager into silence. As a result, the abuse stayed hidden for months.

The truth only came out in July 2022, when the girl gave birth at home. Medical staff who attended to her encouraged her to open a case with police. She then told investigators that her own father was the father of her baby.

Later, DNA testing confirmed her account. The results showed that the accused was the biological father of the child.

During the trial, the man denied the charges. Instead, he claimed that relatives of his wife had made up the case because they disliked him. However, he could not explain the DNA evidence that linked him to the baby.

Ultimately, the court found that the State had proved its case beyond reasonable doubt and rejected his version.

At sentencing, State Prosecutor Matilda Sekhoetsane argued for the prescribed life sentence. She pointed to the girl’s young age and the fact that her own father, the person meant to protect her, committed the crime. The court also heard about the lasting trauma the teenager suffered.

Cases like this remain a serious concern in South Africa, where many child victims know their abusers. For now, the life sentence brings some measure of justice for the girl and her child.
